Participant Agreement & Waiver

Key acknowledgements

By signing this form, you acknowledge and agree to the following:

1. Voluntary participation: You enter and participate voluntarily and of your own free will, without being forced or compelled by management.
2. Assumption of risk: Trampoline and adventure activities involve physical movements (jumping, flipping, climbing, etc.) that can result in minor or major injuries. You accept these risks.
3. No liability on management: To the fullest extent permitted by law, management, staff and owners are not responsible for any injury, accident or health issue occurring during participation, except where liability cannot be excluded under applicable Indian law.
4. Medical fitness: You confirm you are physically fit. Persons with heart issues, back/neck problems, high blood pressure, recent surgeries, pregnancy, or similar conditions should not participate without medical clearance.
5. Responsibility for minors: Parents or guardians are fully responsible for the safety and supervision of children under 18.
6. No alcohol or drugs: Entry and play are strictly prohibited under the influence of alcohol, drugs or intoxicants.
7. Follow instructions: All rules and safety instructions from staff must be followed. Failure may result in removal without refund.

Participant Agreement, Release and Assumption of Risk

I have voluntarily elected to use and, if applicable, to allow the minor child(ren) identified in my booking or registration and all minor children under my supervision (referred to individually and collectively as Child) to use the Krushnai Trampoline Park facilities and equipment located at our Nashik centre in the State of Maharashtra, India (the Facility).

General release

From the date of signing and for all future visits, I release Krushnai Trampoline Park Sportainment (operated by PANCHKRUSHNAI LLP), its owners, officers, employees, contractors, affiliates and agents from liability arising from ordinary risks inherent in recreational trampoline and adventure activities, to the fullest extent permitted by Indian law.

Release of potential injuries

I acknowledge that trampoline and adventure activities are inherently and obviously dangerous. Risks include serious physical or emotional injury, paralysis, death, and damage to personal property. Risks cannot be eliminated. While the Facility is monitored, staff cannot monitor all patrons at all times. Equipment may malfunction despite reasonable maintenance.

Voluntary assumption of risk

I participate voluntarily at my own risk. I am not relying on the Facility to protect me from the actions of other customers or from all risks of injury. Without limiting the foregoing, risks include but are not limited to:

• Death or partial or full paralysis
• Cuts, scrapes, bumps, bruises, transmission of communicable diseases, and allergic reactions
• Sprains, strains, breaks, or serious internal or external injuries to the head, face, neck, torso, spine, limbs, etc., from falling or improper landing
• Heat stroke, heart attack, and dehydration
• Injuries from falling on or colliding with other participants (including “double bouncing”), flipping, bouncing off walls or structures, and landing on the head or neck
• Similar risks to observers standing nearby or taking photographs

Agreement to pay my own medical expenses

I acknowledge and assume the risk of any medical conditions or disabilities I or my Child may have. Any medical assistance required due to an injury sustained at the Facility—including emergency care, hospitalisation, or physical therapy—will be at my own expense.

Release of liability

I, on behalf of myself and my Child (the Releasing Parties), forever, irrevocably and unconditionally release, waive, relinquish, discharge from liability and covenant not to sue Krushnai Trampoline Park Sportainment and PANCHKRUSHNAI LLP from any and all claims, demands, suits and damages arising from use of the Facility, its equipment (trampolines or otherwise), maintenance, supervision, or failure to warn of dangerous conditions, including claims for negligence, property damage, personal injury, emotional injury, illness, paralysis or death, whether occurring inside or outside the premises during related activities.

Arbitration of disputes; time limit

To the extent permitted by law, Releasing Parties waive the right to a jury trial and agree that disputes shall be resolved by binding arbitration in the County of Pune, Maharashtra, India, under the laws of India and the Arbitration and Conciliation Act, 1996 (as amended). Any claim must be brought within one (1) year of the incident.

Photo / video / social media waiver

I consent to being recorded (audio, video or photograph) while at the Facility and authorise Krushnai Trampoline Park Sportainment and its agents to use such recordings in perpetuity for advertising, promotion and similar purposes without additional compensation.

Online booking: promotional photo/video consent is collected separately and is optional. You may still visit and participate if you do not opt in when booking online. Separate on-site notices may apply where recording occurs at the venue.

Term of agreement

This agreement is valid for all future visits to any Krushnai Trampoline Park location unless revoked in writing where permitted by law.

Code of patron responsibility

I and each Child agree to follow these duties:

• a) Exercise good judgment and act responsibly; obey all oral and written warnings.
• b) Not participate under the influence of drugs or alcohol.
• c) Properly use all safety equipment provided.
• d) Not participate with pre-existing medical conditions such as heart/lung conditions, recent surgeries, back/neck problems, high blood pressure, pregnancy, or head/spine injuries without medical approval.
• e) Remove dangerous objects (buckles, pens, jewellery, etc.) and inappropriate attire.
• f) Avoid bodily contact with other patrons except where activity rules allow.
• g) Conform to height, weight and age restrictions.
• h) Avoid overcrowding or overloading sections of the trampoline court.
• i) Use equipment within my own skill level and limitations.
• j) Avoid landing on the head or neck due to risk of serious injury, paralysis or death.
• k) Follow all posted signs and staff directions.
• l) Explain all safety rules to any Child I accompany.

Marketing communications (optional)

If you opt in when booking online, you may receive email promotions and offers from Krushnai Trampoline Park. You may unsubscribe at any time. Opt-in is not required to book or visit.

Parent / guardian representation

If I register a Child, I represent that I am the parent, legal guardian, or hold power of attorney for each Child listed, am at least 18 years of age, and agree to be bound by this agreement including the release of liability and to indemnify and hold harmless Krushnai Trampoline Park from claims arising from the Child’s participation.

In summary

BY MY SIGNATURE (INCLUDING A TYPED DIGITAL SIGNATURE WHEN BOOKING ONLINE), I ACKNOWLEDGE THAT IF I OR ANY OF MY CHILDREN ARE INJURED IN ANY WAY, THIS WAIVER PREVENTS AND PROHIBITS ANY RECOVERY OF MONEY FROM ANY KRUSHNAI TRAMPOLINE PARK RELATED ENTITY, EXCEPT WHERE LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE INDIAN LAW.

I have read and understood this document. I agree it constitutes the entire agreement regarding assumption of risk and release. No employee may waive any provision of this agreement.
